A. Mufflers, Sound Dissipative Devices, and Labels.

1. A vehicle shall be equipped, maintained, and operated to prevent excessive or unusual noise. A motor vehicle shall be equipped with a muffler or other effective noise suppressing system in good working order and in constant operation. A person may not use a muffler cut-out, bypass, or similar device on a vehicle. (See Section 41-6a-1626(1)(a) through (c), Utah Code Annotated.)

2. No person shall remove or render inoperative, other than for purposes of maintenance, repair, or replacement, any muffler, noise control device, or element of design or noise label.

3. No person shall use a vehicle which has had a muffler, noise control device, or element of design or noise label removed or rendered inoperative.

4. No person shall operate a motorcycle manufactured after December 31, 1985, not equipped with an exhaust muffler bearing the Federal EPA required labeling applicable to the motorcycle’s model year, stating that the exhaust system meets the eighty dBA standard at fifty feet, as set out in 40 CFR Parts 205.152 and 205.158.

5. No person shall operate an off-road motorcycle manufactured after December 31, 1985, not equipped with an exhaust muffler bearing the Federal EPA required labeling applicable to the motorcycle’s model year, stating that the exhaust system meets the eighty-two dBA standard at fifty feet, as set out in 40 CFR Parts 205.152 and 205.158.

B. Vehicle Maximum Sound Levels.

1. No person shall operate, or cause to be operated, nor shall a vehicle owner allow a person to operate a vehicle on a public roadway at any time in such a manner that the sound level emitted by the vehicle exceeds the level set forth in Table 2 measured at a distance of twenty-five feet or more, or fifty feet or more, from the center of the lane of travel.

2. No person shall operate, or cause to be operated, nor shall a vehicle owner allow a person to operate a vehicle on a public roadway in such a manner that it is plainly audible at a distance of one thousand feet or more in any direction from the vehicle.

3. No person shall operate, or cause to be operated, nor shall a vehicle owner allow a person to operate a vehicle on a public roadway that exceeds ninety-two dBA when measured from a stationary test at twenty inches from the exhaust outlet and forty-five degrees to its exhaust axis, with the vehicle at fifty percent of maximum RPMs of the vehicle between the hours of seven a.m. to eight p.m.

4. No person shall operate, or cause to be operated, nor shall a vehicle owner allow a person to operate a vehicle under ten thousand GVWR on a public roadway that exceeds eighty-five dBA when measured from a stationary test at twenty inches from the exhaust outlet and forty-five degrees to its exhaust axis, with the vehicle at fifty percent of maximum RPMs of the vehicle between the hours of eight p.m. to seven a.m.

C. Motor Vehicle Horns and Signaling Devices. Sounding of any horn or other auditory signaling device on or in any vehicle on any public roadway or public space (except as a warning of danger as provided in the vehicle code, or pursuant to a special event permit) is prohibited.

D. Standing Motor Vehicles. No person shall operate or cause to be operated any motor vehicle with a gross vehicle weight rating (GVWR) in excess of ten thousand pounds, or any auxiliary equipment attached to such a vehicle, for a period longer than five minutes in any hour while the vehicle is stationary, for reasons other than traffic congestion, on a public roadway or public space or within five hundred feet of a residential use.
