A. It is unlawful for any person knowingly and intentionally to use, to possess or to be present where marijuana is being used or possessed and the use or possession is open, obvious, apparent, and not concealed from those present. No person shall be convicted under this section if the evidence shows that he did not possess or use the substance himself or advise, encourage, or assist anyone else to do so.

B. Any person who violates subsection A of this section shall, on conviction, be fined not more than five hundred dollars. (Ord. 86-06 § 10, 1986: Ord. 5-79, 1979: prior code § 17-22.1)
